ObjectivesTo describe reporting of informed consent in pragmatic trials, justifications for waivers of consent and reporting of alternative approaches to standard written consent. To identify factors associated with (1) not reporting and (2) not obtaining consent.MethodsSurvey of primary trial reports, published 2014–2019, identified using an electronic search filter for pragmatic trials implemented in MEDLINE, and registered in ClinicalTrials.gov.ResultsAmong 1988 trials, 132 (6.6%) did not include a statement about participant consent, 1691 (85.0%) reported consent had been obtained, 139 (7.0%) reported a (...) waiver and 26 (1.3%) reported consent for one aspect (eg, data collection) but a waiver for another (eg, intervention). Of the 165 trials reporting a waiver, 76 (46.1%) provided a justification. Few (53, 2.9%) explicitly reported use of alternative approaches to consent. In multivariable logistic regression analyses, lower journal impact factor (p=0.001) and cluster randomisation (p<0.0001) were significantly associated with not reporting on consent, while trial recency, cluster randomisation, higher-income country settings, health services research and explicit labelling as pragmatic were significantly associated with not obtaining consent (all p<0.0001).DiscussionNot obtaining consent seems to be increasing and is associated with the use of cluster randomisation and pragmatic aims, but neither cluster randomisation nor pragmatism are currently accepted justifications for waivers of consent. Rather than considering either standard written informed consent or waivers of consent, researchers and research ethics committees could consider alternative consent approaches that may facilitate the conduct of pragmatic trials while preserving patient autonomy and the public’s trust in research. In a recent article, ‘Why lockdown of the elderly is not ageist and why levelling down equality is wrong’, Savulescu and Cameron argue that a selective lockdown of older people is not ageist because it would treat people unequally based on morally relevant differences. This response argues that a selective lockdown of older people living in long-term care homes would be unjust because it would allow the expansive liberties of the general public to undermine the basic liberties of older people, (...) and because it would discriminate on the basis of extrinsic disadvantages. BackgroundEarly in the COVID-19 pandemic, the urgent need to discover effective therapies for COVID-19 prompted questions about the ethical problem of randomization along with its widely accepted solution: equipoise. In this scoping review, uses of equipoise in discussions of randomized controlled trials of COVID-19 therapies are evaluated to answer three questions. First, how has equipoise been applied to COVID-19 research? Second, has equipoise been employed accurately? And third, do concerns about equipoise pose a barrier to the ethical conduct of COVID-19 (...) RCTs?MethodsGoogle Scholar and Pubmed were searched for articles containing substantial discussion about equipoise and COVID-19 RCTs. 347 article titles were screened, 91 full text articles were assessed, and 48 articles were included. Uses of equipoise were analyzed and abstracted into seven categories.Results and discussionApproximately two-thirds of articles used equipoise in a way that is consistent with the concept. They invoked equipoise to support RCTs of specific therapies, RCTs in general, and the early termination of RCTs after achieving the primary outcome. Approximately one-third of articles used equipoise in a manner that is inconsistent with the concept. These articles argued that physician preference, widespread use of unproven therapies, patient preference, or expectation of therapeutic benefit may undermine equipoise and render RCTs unethical. In each case, the purported ethical problem can be resolved by correcting the use of equipoise.ConclusionsOur findings highlight the continued relevance of equipoise as it supports the conduct of well-conceived RCTs and provides moral guidance to physicians and researchers as they search for effective therapies for COVID-19. The specialist field of intellectual disability nursing has been subjected to a number of changes since the move towards deinstitutionalisation from the 1970s. Government policies sought to change the nature of the disability workforce from what was labelled as a medicalised approach, towards a more socially oriented model of support. Decades on however, many nurses who specialise in the care of people with intellectual disability are still employed. In Australia, the advent of the National Disability Insurance Scheme offers an apt (...) moment to reflect upon these decades of specialised nursing care as the context of this nursing care will continue to evolve. A review of the published literature was conducted to explore what has shaped the field in the past and how this might inform the future of this speciality area under new policy and service contexts. People with intellectual disability have specific health and support needs that require a specialised workforce. Specialist nurses continue to be needed for people with intellectual disability. In order to discuss the notion of presence, I explore Fascist Italy as an example of a presence-based culture. In the first part of this paper, I focus on the doctrines of "the philosopher of fascism," Giovanni Gentile , in order to show that his programme of cultural awakening revolves around the notion of the "presentification of the past." This notion formed the basis of Gentile's dialectic of the act of thought, which is the kernel of his actual idealism, or (...) actualism. I argue that actualism should primarily be interpreted as an ontology of a historical reality; it expresses the view that reality is history. In his 1914 inaugural "L'esperienza pura e la realtà storica" , Gentile drew this view to its ultimate consequence by developing a view of experience that has some striking parallels with the contemporary views of presence as expounded by Gumbrecht, Runia, and Ankermit. In the second part of my paper, I discuss how Gentile and his collaborators put presence into practice in school reforms, the Enciclopedia Italiana, and in hundreds of monuments, memorials, and exhibitions. Finally, I discuss the 1932 Mostra della rivoluzione fascista, which was not only the apex of Fascist culture politics, but also of the practice of presence. In this context, I argue that this practice should not be seen as a politics of historical interpretation, as Hayden White once held, but as a politics of sublime historical experience, or presence. The presence of presence in Fascist political culture raises some difficult questions for all who embrace the new paradigm, questions that can only be answered if the notion of presence is somehow balanced by the critical historical method, which is the basis for a true dialogue with the past. Often overlooked is the fact that postmodern theory brought to the fore a crisis in the humanities. The implied universalism of the current “iconic turn” in postmodern thinking is a blow to the traditional sciences grouped around national literatures and cultures. In the 1980's, postmodern practitioners in the United States began to assault the discursive practices of the mainstream under the banner of cultural studies. The current crisis in the humanities surfaced in the emancipation of the various studies from their (...) traditional fields in the humanities. The German Studies practiced today in the United States for instance, has no counterpart in Germany's traditional departments of Deutsche Philologie. Whereas the icon in the United States has become an object of investigation for the various studies, it has not yet displaced the littera in Germany's literary sciences. However in the 1990's, the historical sciences in Germany responded to the challenge of the various studies by directing their attention not to cultural studies, but to cultural history, with its well-defined set of methodologies. But what kind of cultural history is it? Is it built on 19th century German foundations, or is it grafted to current North American notions of post-industrial culture? In this paper I show that the supposed opposition between cultural studies and cultural history is artificial. Through a close reading of Hayden White's extremist questioning of historical practice in Metahistory (1973), I demonstrate that there is no opposition between the icon and the littera in this recent radical critique of mainstream humanistic science. The vehement German reaction to his North American assault on European Kultur is based on a misunderstanding of White's premises. Rather than being constructed on a hodgepodge of postmodern approaches, I show that White's postmodern history is in fact conventionally grounded in 19th century Nietzschean thinking. 1 Hans-Peter Söder, Junior Year in Munich Program (Wayne State University). This paper discusses David Roberts's latest book in which he seeks to throw some light on urgent postmodern historiographical issues from the angle of Italian historicism, led by Benedetto Croce and Giovanni Gentile . Focusing on the relationship between theory and practice, Roberts argues that there was a close relationship between Italian historicism and fascism. On the basis of the principle that “reality is nothing but history”, both Croce and Gentile sought to develop a philosophy that connects historical thinking to (...) action. In this context, Gentile's presentist interpretation of the historical sublime eventually led to totalitarianism, whereas Croce's radical historicism formed the basis of a more liberal view of society. In his discussion of the reception of the Italian tradition, Roberts rejects Carlo Ginzburg's and Hayden White's “misreadings” of Croce and Gentile, and concludes that Italian historicism is still relevant to modern historiography. In this paper I show that Roberts, by renouncing an exclusively philosophical approach to the Italian tradition, tends to overlook the underlying issues. In order to redress the balance, I argue that the political issues between Croce and Gentile went back to profound philosophical differences concerning the relationship between philosophy and history on the one hand and between past and present on the other. From this perspective, Ginzburg's and White's debates about the relationship between history and politics, and the role of the historical sublime in historiography, should not be viewed as “misreadings” of Croce and Gentile, but as mere variations on the themes of their predecessors. The relevance of the Italian tradition is therefore not primarily to be found in its response to postmodernism, but in setting the agenda for rethinking the relationship between history and practical life in the contemporary world. To raise the question of the nature of narrative is to invite reflection on the very nature of culture and, possibly, even on the nature of humanity itself. So natural is the impulse to narrate, so inevitable is the form of narrative for any report of the way things really happened, that narrativity could appear problematical only in a culture in which it was absent—absent or, as in some domains of Western intellectual and artistic culture, programmatically refused. As a panglobal (...) fact of culture, narrative and narration are less problems than simply data. As the late Roland Barthes remarked, narrative "is simply there like life itself . . . international, transhistorical, transcultural."1 Far from being a problem, then, narrative might well be considered a solution to a problem of general human concern, namely, the problem of how to translate knowing into telling,2 the problem of fashioning human experience into a form assimilable to structures of meaning that are generally human rather than culture-specific. We may not be able fully to comprehend specific thought patterns of another culture, but we have relatively less difficulty understanding a story coming from another culture, however exotic that culture may appear to us. A historical investigation of the exclusion of Africa and Asia from modern histories of philosophy.

Various decision theories share a troubling implication. They imply that, for any finite amount of value, it would be better to wager it all for a vanishingly small probability of some greater value. Counterintuitive as it might be, this fanaticism has seemingly compelling independent arguments in its favour. In this paper, I consider perhaps the most prima facie compelling such argument: an Egyptology argument (an analogue of the Egyptology argument from population ethics). I show that, despite recent objections from Russell (...) (2023) and Goodsell (2021), the argument’s premises can be justified and defended, and the argument itself remains compelling. (shrink)

In this international and interdisciplinary collection of critical essays, distinguished contributors examine a crucial premise of traditional readings of Plato's dialogues: that Plato's own doctrines and arguments can be read off the statements made in the dialogues by Socrates and other leading characters. In this paper we consider a natural generalization of the Principle of Instantial Relevance and give a complete characterization of the probabilistic belief functions satisfying this principle as a family of discrete probability functions parameterized by a single real δ ∊ [0, 1).

We consider the problem of induction over languages containing binary relations and outline a way of interpreting and constructing a class of probability functions on the sentences of such a language. Some principles of inductive reasoning satisfied by these probability functions are discussed, leading in turn to a representation theorem for a more general class of probability functions satisfying these principles.

Thought experiments feature prominently in both scientific and philosophical methods. In this paper, I investigate two questions surrounding knowledge in the thought experiment process. First, on what implicit knowledge do thought experiments rely? Second, what provides epistemic justification for beliefs acquired through the process? I draw upon neo-Aristotelian metaphysics and Husserlian phenomenology to argue that essence is the object of implicit knowledge that anchors the imagined possibilities involved in thought experiments to the actual world, and that this essentialist knowledge enables (...) the possibility of prima facie justification being conferred by the phenomenological givenness of thought experiment scenarios. Various philosophers accept moral views that are impartial, additive, and risk-neutral with respect to moral betterness. But, if that risk neutrality is spelt out according to expected value theory alone, such views face a dire reductio ad absurdum. If the expected sum of value in humanity's future is undefined--if, e.g., the probability distribution over possible values of the future resembles the Pasadena game, or a Cauchy distribution--then those views say that no option is ever better than any other. And, as (...) I argue, this holds in practice: our evidence supports such a probability distribution. Indeed, it supports a probability distribution that cannot be evaluated even if we adopt one of the various extensions of expected value theory proposed in the literature. Must we therefore reject all impartial, additive, risk-neutral moral theories? It turns out that we need not. I develop an alternative solution: a new method of extending expected value theory, which allows us to deal with this distribution and to salvage those moral views. I also examine how this solution affects one of the most notable implications of those views--namely, longtermism. (shrink)

Virtue ethics or natural law? Most contemporary accounts treat these as rival approaches. This book argues both are necessary since virtue is commitment to objective human goods. It also argues integrity is planning one's life by commitment to reasonableness, rejects traditional natural law and virtue ethics for more deontological accounts of the human good and virtue, and explains human personhood accordingly. Part 2 then analyses Aquinas's accounts of emotion, the body and happiness in terms of integrity.

Radical and autopoietic enactivists disagree concerning how to understand the concept of sense-making in enactivist discourse and the extent of its distribution within the organic domain. I situate this debate within a broader conflict of commitments to naturalism on the part of radical enactivists, and to phenomenology on the part of autopoietic enactivists. I argue that autopoietic enactivists are in part responsible for the obscurity of the notion of sense-making by attributing it univocally to sentient and non-sentient beings and following (...) Hans Jonas in maintaining a phenomenological dimension to life-mind continuity among all living beings, sentient or non-sentient. I propose following Merleau-Ponty instead, who offers a properly phenomenological notion of sense-making for which sentience is a necessary condition. Against radicalist efforts to replace sense-making with a deflationary, naturalist conception of intentionality, I discuss the role of the phenomenological notion of sense-making for understanding animal behavior and experience. In recent years, social cognition approaches to human evolution and Material Engagement Theory have offered new theoretical resources to advance our understanding of the prehistoric hominin mind. To date, however, these two approaches have developed largely in isolation from one another. I argue that there is a gap between social- and material-centred approaches, and that this is precisely the sociomateriality of the appearance of ancestral hominin bodies, which evolved under selective pressure to develop increasingly complex, cooperative sociality. To get this (...) sociomaterial body in focus, I develop an esthesiological framework, appropriated from Merleau-Ponty (2003), for interpreting the expressive body in an evolutionary and comparative context. The guiding hypothesis of esthesiology is that before being rationality (social or material), “humanity is another corporeity” (Merleau-Ponty, 2003, p. 208). Esthesiology studies the appearance of the body and its sense organs as an intertwining locus of a sensing power (the ability to see, to touch, etc.) and a sensible character (the visible, touchable body). It is this dual-aspect character of the body that facilitates the most basic affective and sensorimotor modes of sociality. Examining these features from a comparative perspective, we find that the human body is distinctively suited to prosocial communication and cooperation: a more cooperative eye, an exposed and communicative skin. I thus propose a cooperative body hypothesis, by analogy with the cooperative eye hypothesis (Tomasello et al., 2007). Esthesiology provides a framework for integrating and interpreting a wide range of otherwise disconnected facts concerning human and nonhuman animal bodies, forms of life, cognition, and evolution, thereby bridging the gap between social cognition and material engagement perspectives. In doing so, however, it not only solves problems and proposes new directions of investigation, but also demands theoretical revisions from each. (shrink)

In 1972, the young philosopher Peter Singer published "Famine, Affluence and Morality," which rapidly became one of the most widely discussed essays in applied ethics. Through this article, Singer presents his view that we have the same moral obligations to those far away as we do to those close to us. He argued that choosing not to send life-saving money to starving people on the other side of the earth is the moral equivalent of neglecting to save drowning children (...) because we prefer not to muddy our shoes. Which is better: a guarantee of a modest amount of moral value, or a tiny probability of arbitrarily large value? To prefer the latter seems fanatical. But, as I argue, avoiding such fanaticism brings severe problems. To do so, we must decline intuitively attractive trade-offs; rank structurally identical pairs of lotteries inconsistently, or else admit absurd sensitivity to tiny probability differences; have rankings depend on remote, unaffected events ; and often neglect to rank lotteries as we already know we would (...) if we learned more. Compared to these implications, fanaticism is highly plausible. (shrink)

This paper clarifies Merleau-Ponty’s distinction between speaking and spoken speech, and the relation between the two, in his Phenomenology of Perception. Against a common interpretation, I argue on exegetical and philosophical grounds that the distinction should not be understood as one between two kinds of speech, but rather between two internally related dimensions present in all speech. This suggests an interdependence between speaking and spoken aspects of speech, and some commentators have critiqued Merleau-Ponty for claiming a priority of speaking over (...) spoken speech. However, there is a sense in which Merleau-Ponty is right to emphasize the priority, namely, in terms of the ontological priority of the speaking subject with respect to language understood as a constituted cultural ideality. The latter only maintains its ontological status insofar as it is taken up by a language community. I favorably contrast Merleau-Ponty’s views on this question to those of the late Heidegger and de Saussure, and suggest potential applications of this clarified position for contemporary discussions in philosophy of language. In the Protagoras, Plato subjects virtue to examination starting from two main questions: Can it be taught? and Is it one thing or many? In the course of their discussion, Protagoras, Socrates, and the others who speak in the dialogue regard virtue from a variety of intriguing perspectives. A provisional conclusion is that the meaning assigned virtue in this dialogue remains elusive, but must certainly be more complex in character than is normally allowed in modernizing philosophical interpretations of it. If (...) it cannot be taught, we nevertheless find ourselves learning about it; and if it is not clearly a unity about which we read, we find ourselves prompted to look for an understanding of it that can in due course emerge as such. Approaches to the naturalization of phenomenology usually understand naturalization as a matter of rendering continuous the methods, epistemologies, and ontologies of phenomenological and natural scientific inquiry. Presupposed in this statement of the problematic, however, is that there is an original discontinuity, a rupture between phenomenology and the natural sciences that must be remedied. I propose that this way of thinking about the issue is rooted in a simplistic understanding of the phenomenological reduction that entails certain assumptions about the subject matter (...) of phenomenology and its relationship to the natural sciences. By contrast, Merleau‐Ponty's first work, The Structure of Behavior, presents a radically different approach to the phenomenological reduction, one that traverses the natural sciences and integrates them into phenomenology from the outset. I outline the argument for this position in The Structure of Behavior and then discuss consequences for current methodological issues surrounding the naturalization of phenomenology, focusing on the relationship between empirical sciences of mind, phenomenological psychology, and transcendental phenomenology. This novel exegesis of Merleau‐Ponty's view on the reduction offers new insight into his oft‐quoted remark that the phenomenological reduction is impossible to complete. (shrink)

Confirmation bias is one of the most widely discussed epistemically problematic cognitions, challenging reliable belief formation and the correction of inaccurate views. Given its problematic nature, it remains unclear why the bias evolved and is still with us today. To offer an explanation, several philosophers and scientists have argued that the bias is in fact adaptive. I critically discuss three recent proposals of this kind before developing a novel alternative, what I call the ‘reality-matching account’. According to the account, confirmation (...) bias evolved because it helps us influence people and social structures so that they come to match our beliefs about them. This can result in significant developmental and epistemic benefits for us and other people, ensuring that over time we don’t become epistemically disconnected from social reality but can navigate it more easily. While that might not be the only evolved function of confirmation bias, it is an important one that has so far been neglected in the theorizing on the bias. (shrink)

This chapter provides an introduction to higher-order metaphysics as well as to the contributions to this volume. We discuss five topics, corresponding to the five parts of this volume, and summarize the contributions to each part. First, we motivate the usefulness of higher-order quantification in metaphysics using a number of examples, and discuss the question of how such quantifiers should be interpreted. We provide a brief introduction to the most common forms of higher-order logics used in metaphysics, and indicate a (...) number of questions which can be raised in such systems using logical vocabulary alone. Using a further example, we return to applications of higher-order logics in metaphysics. We also mention key developments in the history of higher-order logic as it pertains to metaphysics. Finally, we mention certain arguments which have been raised against the use of higher-order logic, and some ways of responding to them. (shrink)

In this paper I develop a novel account of the phenomenality of language by focusing on characteristics of perceived speech. I explore the extent to which the spoken word can be said to have a horizonal structure similar to that of spatiotemporal objects: our perception of each is informed by habitual associations and expectations formed through past experiences of the object or word and other associated objects and experiences. Specifically, the horizonal structure of speech in use can fruitfully be compared (...) to that of a tool in use. The comparison suggests an account of our linguistic faculty as continuous with more foundational faculties of perception and action. I provide empirical corroboration of this account by drawing on recent neuroimaging studies of the multimodal, sensorimotor bases of speech comprehension. I then discuss how such an understanding of our linguistic ability helps advocates of embodied, non-representationalist accounts of cognition respond to a common objection. Critics grant that embodied approaches may be adequate to account for lower-level, online modes of cognition, such as perception and action, which directly engage their object. But they question whether such approaches can “scale up” to higher modes of cognition, such as imagination, memory, thought, and language, which can entertain absent, non-existent, or abstract objects. By providing a plausible account of the continuity of lower cognition and language-involving cognition, my approach responds to this objection, at least where language is concerned. (shrink)
